This agenda is prepared and posted pursuant to the requirements of Government Code Section 54954.2. By listing a topic on this agenda, the Planning Commission has expressed its intent to discuss and act on each item. In addition to any action identified in the brief general description of each item, the action that may be taken shall include: a referral to staff with specific requests for information; continuance; specific direction to staff concerning the policy or mission of the item; discontinuance of consideration; adoption, approval or disapproval or recommendation thereof.

Participation includes assistance under the Americans with Disabilities Act to provide an equally effective opportunity for individuals with a disability to participate in and benefit from City activities. For the hearing impaired, the City has assisted listening equipment available. For TDD (Telecommunications Devices for the Deaf) service, please call 800-735-2929. In order for the City to make reasonable accommodation arrangements for the use of this assisted listening equipment, notification is required by at least 4:00 p.m. the Friday before the meeting by calling 925-0951, extension 307. a.††††† EXTENSION OF TIME FOR A PLANNED DEVELOPMENT PERMIT FOR TEMPLO EL SALVADOR, 800 WEST HIDDEN PINES WAY, PD-2004-026, E-2004-051. Review of a request for an extension of time for a Planned Development Permit to allow the construction of a new church in two phases. Phase I is the construction of a 9,989 square foot multi-purpose building. Phase II is the construction of an 11,500 square foot sanctuary building. The land use designation of the site is CF (Community Facilities) and the zoning designation is PD/PF (Planned Development/ Public Facilities), Assessorís Parcel No. 117-930-014. b.††††† CONDITIONAL USE PERMIT FOR COLE ENTERPRISES, LLC, FOR SCREENED OUTDOOR STORAGE AND A TRUCK TERMINAL, 1525 WEST BETTERAVIA ROAD, U-2009-002, E-2009-003. Review of a Conditional Use Permit to allow a screened materials storage yard(s); trucking terminals, including outdoor truck storage; a diesel fuel tank/dispenser; indoor vehicle maintenance and repair; contractors yards; associated offices uses; limited outdoor maintenance and servicing; limited retail; driveways and parking, in a PD/CM (Planned Development/Commercial Manufacturing) zoning district, Assessorís Parcel No. 117-320-008. The project qualifies for a Class 1 categorical exemption. No further environmental review is required. (Planner: Bill Scott)

c.††††† APPEAL OF A ZONING ADMINISTRATOR DECISION TO DENY THE ESTABLISHMENT OF OUTSIDE STORAGE, FOR CARNICERIA SU MESA, 123 SOUTH BLOSSER ROAD, U-2010-010, E-2010-010. An appeal from Mr. Tom Martinez, architect for Mr. Legaspi, business owner of CarnicerŪa Su Mesa, of the Zoning Administratorís decision to deny the establishment of outside storage in a PD/C-2 (Planned Development/General Commercial) zoning district, Assessorís Parcel Number 117-200-018, pursuant to Municipal Code Sections 12-13.16 and 12.43. d.††††† TENTATIVE PARCEL MAP FOR SIENA APARTMENTS, LOCATED AT THE NORTH-WEST CORNER OF BLOSSER ROAD AND SONYA LANE, TRACT 5970, E-2010-013. Review of a tentative parcel map that would create one (1) residential lot from one (1) lot with 117 condominium airspace units and one (1) common lot on a 10.75 acre lot. The zoning of the site is PD/R-3 (Planned Development/High Density Residential), various Assessorís Parcel Numbers. The environmental impacts of this project have been adequately addressed in a Final Environmental Impact Report (EIR), E-88-10, and the Supplement to the EIR, E-2003-022, (SCH#90010930) for the City of Santa Maria Sphere of Influence Boundary Amendment and Concurrent Annexation Project certified on September 1, 1992. e.††††† PLANNED DEVELOPMENT PERMIT FOR SIENA APARTMENTS LOCATED AT THE NORTHWEST CORNER OF BLOSSER ROAD AND SONYA LANE, PD-2010-003, E-2010-013. Review of a Planned Development Permit for construction of 211 apartments, including a community center, pool, spa, play equipment and landscaped open space, in a PD/R-3 (Planned Development/High Density Residential, 211 dwelling units maximum) zoning district, various Assessor's Parcel Numbers. The environmental impacts of the Siena Apartments have been adequately addressed in a Final Environmental Impact Report (EIR), E-88-10, and the Supplement to the EIR, E-2003-022, (SCH#90010930) for the City of Santa Maria Sphere of Influence Boundary Amendment and Concurrent Annexation Project certified on September 1, 1992. 2.                  CONDITIONAL USE PERMIT FOR PARAGON OF SANTA MARIA, 2330 WESTGATE ROAD, U-2010-028, E-2010-045. Review of a Conditional Use Permit to allow the establishment of a martial arts gym in a 2,628 square foot portion of an existing 26,950 square foot building, located in a PD/CM (Planned Development/Commercial Manufacturing) zoning district, Assessorís Parcel No. 111-400-077. The project qualifies for a Class 1 categorical exemption. No further environmental review is required. (Planner: Neda Zayer)

3.                  MASTER PLANNED DEVELOPMENT PERMIT AND DESIGN GUIDELINES FOR THE BETTERAVIA INDUSTRIAL PARK (ZIMMERMAN), LOCATED NEAR THE NORTH-EAST CORNER OF SOUTH BLOSSER ROAD AND WEST BETTERAVIA ROAD, PD-2009-006, E-2009-025. Review of a Master Planned Development Permit and design guidelines for the Betteravia Industrial Park to allow future development on thirty-eight (38) industrial lots, in a PD/M-1 (Planned Development/ Light Manufacturing) zoning district, Assessorís Parcel No. 117-330-082. A Mitigated Negative Declaration was prepared for the project under the provisions of the California Environmental Quality Act. No further environmental review is required. (Planner: Greg Stones)

4.                  AMENDMENT TO TITLE 12 OF THE MUNICIPAL CODE PERTAINING TO SECTION 12-34 PERTAINING TO SANDWICH BOARD, TEMPORARY, AND BOW/FEATHER SIGNS, Z-2010-005, E-2010-048. The proposed zoning text amendment would extend the sunset for sandwich board signs for one year within the Downtown Specific Plan area, allow temporary signs for up to sixty days within a six month time frame and allow posting on vacant land, and confirm that the use of bow/feather signs are prohibited. The amendment would apply citywide. The project qualifies for a Class 11 categorical exemption. No further environmental review is required. (Planner: Larry Appel)
