This agenda is prepared and posted pursuant to the requirements of Government Code Section 54954.2. By listing a topic on this agenda, the Planning Commission has expressed its intent to discuss and act on each item. In addition to any action identified in the brief general description of each item, the action that may be taken shall include: a referral to staff with specific requests for information; continuance; specific direction to staff concerning the policy or mission of the item; discontinuance of consideration; adoption, approval or disapproval or recommendation thereof.

Participation includes assistance under the Americans with Disabilities Act to provide an equally effective opportunity for individuals with a disability to participate in and benefit from City activities. For the hearing impaired, the City has assisted listening equipment available. For TDD (Telecommunications Devices for the Deaf) service, please call 800-735-2929. In order for the City to make reasonable accommodation arrangements for the use of this assisted listening equipment, notification is required by at least 4:00 p.m. the Friday before the meeting by calling 925-0951, extension 307. This equipment can also be used for translation by Spanish-only speaking persons. APPROVAL OF PLANNING COMMISSION MINUTES OF OCTOBER 6, 2010.

 

PUBLIC COMMENT PERIOD (not to exceed a total of 15 minutes):

Each member of the audience may address the Commission on any subject within the Commission’s business. Each member of the audience and each subject is limited to discussion of three minutes or as otherwise directed by the Chair.

 

 

1.            CONSENT CALENDAR: The consent calendar is approved with one motion. These items are read only on request of Commission members. Should anyone, including members of the public, wish to discuss or disapprove any item, it must be dropped from the blanket motion and considered as a separate item.

a.      EXTENSION OF TIME FOR A PLANNED DEVELOPMENT PERMIT FOR THE SANTA MARIA FREEWAY CENTER, 1000 EAST BETTERAVIA ROAD, PD-2002-020, E-2002-041.  Review of a request for an extension of time for a Planned Development Permit to allow the construction of one gas station (with mini-mart) with a drive-thru car wash, two drive-thru restaurants, one conceptual sit down restaurant and a multi-tenant building in a PD/FS (Planned Development/Freeway Service) zoning district. The total square footage for five buildings would be 23,455 square feet. Assessor’s Parcel Nos. 128-136-008, -009. (Planner: Brian Halvorson)

STAFF RECOMMENDATION: By motion, approve the extension of time for one year.

b.      CONDITIONAL USE PERMIT FOR COLE ENTERPRISES, LLC, FOR SCREENED OUTDOOR STORAGE AND A TRUCK TERMINAL, 1525 WEST BETTERAVIA ROAD, U-2009-002, E-2009-003. Review of a Conditional Use Permit to allow a screened materials storage yard(s); trucking terminals, including outdoor truck storage; a diesel fuel tank/dispenser; indoor vehicle maintenance and repair; contractors yards; associated offices uses; limited outdoor maintenance and servicing; limited retail; driveways and parking, in a PD/CM (Planned Development/Commercial Manufacturing) zoning district, Assessor’s Parcel No. 117-320-008. The project qualifies for a Class 1 categorical exemption. No further environmental review is required. (Planner: Bill Scott)

STAFF RECOMMENDATION: By motion, continue to the Planning Commission meeting of January 19, 2011.

 

 

PUBLIC HEARINGS:

2.            PLANNED DEVELOPMENT PERMIT FOR HERITAGE AT WESTGATE RANCH, NORTH OF BATTLES ROAD, SOUTH OF LA BREA AVENUE, EAST OF “A” STREET AND WEST OF BLOSSER ROAD, PD-2010-004, E-2010-021.  Review of a Planned Development Permit to allow construction of 296 single family residential homes, a community park, play equipment and walking/bicycle trails, in a proposed PD/RSL-1 (Planned Development/Single Family Small Lot) zoning district, Assessor's Parcel No. 117-240-029. The environmental impacts of this project have been adequately addressed in a Final Environmental Impact Report (EIR), E-88-10, and the Supplement to the EIR, E-2003-022, (SCH#90010930) for the City of Santa Maria Sphere of Influence Boundary Amendment and Concurrent Annexation Project certified on September 1, 1992. No further environmental review is required.  (Planner: Brian Halvorson)

3.                  RESCISSION OF BUSINESS LICENSE APPLICATION APPROVAL FOR MOM AND POP FURNITURE GALLERY, 733 AND 741 OAK STREET, SP-2010-030.  An appeal by Samantha Orchid, of a Community Development Director decision, to rescind a Business License application approval for 733 and 741 Oak Street (SP-2010-030), Assessor’s Parcel Number 125-200-029. The applicant proposes to locate a retail furniture store in a building that is zoned Planned Development Commercial Manufacturing (PD/CM) which is not permitted. This project qualifies for a Class 1 categorical exemption. No further environmental review is required. (Planner: Frank Albro)
