This agenda is prepared and posted pursuant to the requirements of Government Code Section 54954.2. By listing a topic on this agenda, the Planning Commission has expressed its intent to discuss and act on each item. In addition to any action identified in the brief general description of each item, the action that may be taken shall include: a referral to staff with specific requests for information; continuance; specific direction to staff concerning the policy or mission of the item; discontinuance of consideration; adoption, approval or disapproval or recommendation thereof.

a.†††††††† EXTENSION OF TIME FOR A PLANNED DEVELOPMENT PERMIT FOR THE SANTA MARIA FREEWAY CENTER, 1000 EAST BETTERAVIA ROAD, PD-2002-020, E-2002-041. Review of a request for an extension of time for a Planned Development Permit to allow construction of one gas station (with mini-mart and drive-thru car wash), two drive-thru restaurants, one conceptual sit-down restaurant and a multi-tenant building in a PD/FS (Planned Development/Freeway Service) zoning district, Assessorís Parcel Nos. 128-136-008 and 128-136-009. STAFF RECOMMENDATION: By motion, approve the extension of time for one year to December 3, 2013.

b.                 EXTENSION OF TIME FOR A PLANNED DEVELOPMENT PERMIT FOR BLOSSER COMMERCIAL #2, 715 SOUTH BLOSSER ROAD, PD-2007-001, E-2007-004. Review of a request for an extension of time for a Planned Development Permit to allow construction of a 34,281 square foot industrial building in a PD/CM (Planned Development/Commercial/Manufacturing) zoning district, Assessor's Parcel No. 117-190-058.(Project Planner: Brian Halvorson)

STAFF RECOMMENDATION: By motion, approve the extension of time for one year to December 6, 2013.

 

 

PUBLIC HEARINGS:

2.                  CONDITIONAL USE PERMIT FOR SMITTYíS TOWING, 1250 WEST BETTERAVIA ROAD, U-2012-0030, E-2012-0033. Review of a Conditional Use Permit to allow the establishment of a dispatch and towing yard, outside storage of vehicles, and barbed wire on chain-link fencing at 1250 West Betteravia Road located in a PD/CM (Planned Development/Commercial/Manufacturing) zoning district, Assessorís Parcel No. 111-400-003. The project qualifies for a Class 1 categorical exemption. No further environmental review is required. (Project Planner: Neda Zayer)

3.                  DOWNTOWN SPECIFIC PLAN DEVELOPMENT REVIEW CONDITIONAL USE PERMIT FOR SKIPíS BBQ STEAKHOUSE FOR A NIGHTCLUB IN CONJUNCTION WITH AN EXISTING RESTAURANT, 229 TOWN CENTER WEST, SUITE A-17, DPDRCUP-2012-0002. Review of a Downtown Specific Plan Development Review Conditional Use Permit to allow the establishment of a nightclub in conjunction with an existing 4,700 square foot restaurant serving alcohol, in the Downtown Specific Plan Town Center zoning district, Assessorís Parcel No. 123-280-013. This project is a class 1 categorical exemption based on Section 15301 of the State CEQA Guidelines. No further environmental review is required. (Project Planner: Frank Albro)

Review of a mitigated negative declaration of environmental impact and a Planned Development Permit to allow a metals and California Redemption Value (CRV) recycling facility, including screened outdoor storage, a modified landscape requirement, and the use of barbed wire for special safety and security needs, in a PD/CM (Planned Development/Commercial/Manufacturing) zoning district, Assessorís Parcel No. 117-320-003. Review of a modification to or revocation of Planned Development Permit PD-2004-010 based on failure to comply with conditions of approval relating to the construction of a gas station with a 2,500 square foot mini-mart, a 1,042 square foot car wash, and a 3,024 square foot canopy area in a PD/C-2, (Planned Development/General Commercial) zoning district, Assessorís Parcel Numbers 123-011-003 and 123-011-026.
